1. Agreement to Terms

By downloading, installing, accessing, or using Untether ("the Software"), you agree to be legally bound by these Terms of Service and End User License Agreement ("Terms"). If you do not agree to these Terms, do not download, install, or use the Software.

Non-Medical Device Disclaimer

Untether is a generic, assistive voice-to-text dictation utility and NOT a certified medical device.

The Software has not been evaluated, approved, or cleared by the U.S. Food and Drug Administration (FDA), the European Medicines Agency (EMA), or any other medical regulatory authority under EU MDR 2017/745 or equivalent statutes. The Software is not designed, marketed, or intended to diagnose, cure, treat, or prevent any medical disease or condition, nor to serve as a legal Electronic Health Record (EHR) system. Any clinical templates, SOAP formatting, or medical terminology transcriptions provided by the Software are purely algorithmic suggestions. Healthcare professionals and clinical users retain 100% sole responsibility for reviewing, editing, verifying, and validating all transcribed content before saving, signing, or relying upon it in patient care.

2. "AS-IS" Warranty Disclaimer

Notice to all users:

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR DISTRIBUTORS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.

3. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Alexander Eriksen, Untether, or its developers and contributors be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages (including, but not limited to, loss of data, loss of profits, business interruption, clinical errors, or equipment damage) however caused and on any theory of liability.

In all circumstances, total aggregate liability arising out of or related to the Software shall not exceed the amount actually paid by you for the Software in the thirty (30) days preceding the incident, or USD $0.00 if the Software was acquired free of charge.

4. Wiretapping & Audio Recording Consent Compliance

You represent and warrant that your use of the Software complies with all federal, state, local, and international laws regarding wiretapping, eavesdropping, and electronic audio recording (including one-party and two-party consent statutes). You agree that you are solely responsible for obtaining any necessary consents from all participating speakers before capturing or processing audio using the Software.

5. Third-Party Services & API Keys

Untether operates via a "Bring Your Own Key" (BYOK) architecture for cloud models. You are solely responsible for maintaining the security of your API keys (e.g., Groq API keys) and complying with third-party service provider terms. Untether is not responsible for API rate limits, provider outages, or charges incurred under your personal API accounts.
